Privacy Policy

ModernDigitalCraft, registered at 38108 Simonstraße 11, Braunschweig, Germany, is committed to protecting the privacy and personal data of all website visitors and clients in strict compliance with Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR) and the German Federal Data Protection Act (BDSG).

We collect and process personal data — including names, email addresses, phone numbers, and company affiliations — exclusively for the purposes of client communication, project delivery, invoice processing, and statutory tax reporting obligations. This data is processed on the legal basis of Art. 6(1)(b) GDPR (contractual necessity) and Art. 6(1)(f) GDPR (legitimate interest).

Personal data is stored within encrypted, EU-hosted cloud infrastructure in compliance with ISO/IEC 27001 information security standards. We employ industry-standard TLS 1.3 encryption for all data transmissions and maintain rigorous access controls to prevent unauthorized disclosure.

We do not sell, rent, lease, or distribute personal information to any third-party data brokers or marketing intermediaries. Personal data is shared only with explicitly authorized service providers (e.g., payment processors, cloud hosting providers) bound by Data Processing Agreements (DPAs) in accordance with Art. 28 GDPR.

You have the right to access, rectify, erase, restrict processing, and port your personal data under Arts. 15–22 GDPR. To exercise these rights, contact our Data Protection Officer at [email protected]. We will respond to all requests within 30 days.

Data retention periods are limited to the duration necessary for the purposes for which it was collected, or as required by applicable tax and commercial record-keeping obligations (typically 10 years for financial records under German commercial law).

Terms of Service

All digital services, software deliverables, and engineering advisory packages provided by ModernDigitalCraft are governed by explicitly contracted Statements of Work (SOW) executed between the Client and ModernDigitalCraft. These Terms of Service establish the general framework governing all commercial engagements.

Upon complete settlement of all agreed commercial invoices, ModernDigitalCraft assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, source code, and digital assets directly to the Client. No recurring license fees or dependency obligations shall survive final payment.

ModernDigitalCraft reserves the right to showcase anonymized case studies and aggregate performance metrics from completed projects in its public portfolio, unless the Client explicitly opts out in writing prior to project commencement.

Project timelines are communicated in good faith based on scope assessments. Delays caused by third-party integrations, Client-side content provision, or force majeure events shall extend delivery schedules proportionally. Both parties agree to maintain reasonable communication throughout the engagement lifecycle.

Any disputes arising from commercial engagements shall be resolved first through good-faith mediation. If mediation fails, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Braunschweig, Germany, in accordance with German substantive law.

Refund Policy

ModernDigitalCraft is committed to transparent and fair commercial practices. This Refund Policy outlines the conditions under which refunds may be issued for services rendered under contracted Statements of Work.

Pre-Project Cancellation: If a project is cancelled by the Client prior to the commencement of any deliverable work, a full refund of all advance payments shall be issued within 14 business days, less any non-recoverable third-party costs already incurred (e.g., domain registrations, software licenses procured specifically for the project).

Mid-Project Cancellation: If a project is cancelled after work has commenced, the Client shall be invoiced proportionally for all work completed and milestones achieved up to the date of cancellation. Any advance payments exceeding the proportional invoice shall be refunded within 14 business days.

Post-Delivery Disputes: If the delivered work materially fails to meet the specifications outlined in the executed Statement of Work, the Client must submit a written dispute within 14 days of delivery. ModernDigitalCraft will review the dispute in good faith and, if the claim is substantiated, will either remedy the deficiencies at no additional cost or issue a proportional refund.

SLA Retainer Cancellation: Monthly SLA maintenance retainers may be cancelled with 30 days' written notice. No refund shall be issued for the current billing period in which cancellation is submitted.

Refund requests should be directed to [email protected] with the subject line "Refund Request — [Project Reference]."
